MEMBERSHIP TERMS

1. General

The following terms and conditions (“Membership Terms”) are valid between you and Singular AB (Reg. No. 559226-1647) (“Singular”, “us”, “we”) and apply to your subscription to the services of Singular Society (“the Service”).

By becoming a member, you confirm that you have read the Membership Terms and that you accept to be bound by them. Before you accept the Membership Terms you shall also read and understand our Privacy Policy [LINK].

Singular Society is a subscription service that offer products as a service. Our members get exclusive access to responsibly made products of the highest quality and design from some of the world’s best manufacturers – at the price of what they cost to make. 

Singular reserves the right to revise the Membership Terms at any time. The date of the latest update is found in the final section of the Membership Terms.

2. Membership

As a member of Singular Society, you will get exclusive access to purchase responsibly made clothes, accessories and products for your home of the highest quality and design from some of the world’s best manufacturers at the price they cost to make. You will also receive regular information updates regarding products, services and general information from Singular.

To become a member, you must be at least 20 years of age and be a resident within the EU.

Your membership is personal, non-transferable and subject to these Membership Terms. Singular apply a limit of one membership per person.

3. Membership plans

Singular Society offers two different types of membership – Base and Plus - both available with the option to pay monthly or annually.

BASE

Monthly

SEK 95 (9,5 €) per month. Total amount: SEK 1,140 (114 €).

Base allows you to buy five (5) products per month.

Annually

SEK 79 (7,5 €) per month. Total amount: SEK 950 (95 €).

Base allows you to buy five (5) products per month.

 

PLUS

Monthly

SEK 195 (19,5 €) per month. Total amount: SEK 2340 (234 €).

Plus allows you to buy 25 products per month.
Access to Pre-orders.
(+Invite friends to join Singular Society.)

Annually

SEK 163 (16,3 €) per month. Total amount: SEK 1950 (195 €).

Plus allows you to buy 25 products per month.
Access to Pre-orders.
(+Invite friends to join Singular Society.)

Pre-orders: With the Plus-membership you have access to Pre-orders for certain products, giving you priority to buying new products not yet available for Base-members of the Service.

Invite friends: With the Plus-membership you can invite three (3) friends to Singular Society. This function is found at “My Account”. Simply enter the e-mail of the person you wish to invite to the Service. 

4. Payment

We use Shopify’s payment services. For more information, please see Shopify’s Payment Terms [LINK].

We accept the following payment methods:

All membership payments will be charged in SEK (Swedish crowns). Singular is not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

Monthly payments

If your membership is a monthly subscription you will be charged the cost for the subscription on a monthly basis. The first payment will be made on the day you sign up for the Service. The second payment will be made on the same date the following month. For example, if you signed up and paid for the Service on 1 January, the second payment will be made on 1 February, and so on.

Annual payments

If your membership is an annual subscription you will be charged a one-time fee on the day you sign up for your membership.

Please note that additional fees may be applicable for certain payment methods.

5. Availability and use of the service

Once you have paid for your membership you will be given immediate access to the Service.

You place your orders via our website www.singular-society.com, which is open 24/7. You may submit your order at any time.

Should you have any problems submitting an order on our website, or should you have any questions regarding the Service, please contact us at hello@singular-scoiety.com. Our customer service’s opening hours are 09.00 – 18.00 CET Monday to Friday. We will always do our best to answer any questions as quick and accurate as possible.

6. Monthly purchase period

The amount of purchases you as a member can make per month depends on your chosen membership plan. With the Base-membership you can buy up to five (5) products per monthly purchase period. With the Plus-membership you can buy up to 25 products per monthly purchase period.

With the Plus-membership you also have access to Pre-orders for certain products, giving you priority to buying new products not yet available for Base-members of the Service. Please note that when you purchase a product on Pre-order, this will be regarded as a purchase made during your current monthly purchase period at the time for the purchase.

The first monthly purchase period starts from the day you sign up for your membership and lasts for one month.  For example, if you signed up and paid for the Service on 1 January, your monthly purchase period lasts until 31 January. A new monthly purchase period will then commence on 1 February, and last until 28 (or 29) February. A new monthly purchase period will commence on 1 March, and so on.

Unused product purchases are not transferred from one monthly purchase period to another monthly purchase period. The amount of purchases included in your membership plan is therefore the maximum amount of purchases you can make per monthly purchase period.

There are no minimum purchase requirements for any of our membership plans.

Please note that some of our products are sold in numbers. These will always be regarded as one (1) product. For example, if you buy a product consisting of two champagne glasses, your monthly purchase period will only be debited with one (1) purchased product.

7. Upgrading your membership

You may upgrade your membership from Base to Plus at any time during the 12-month period. However, please note that you cannot downgrade your membership during the 12-month period. When you upgrade your membership your initial 12-month period will not be extended. Rather you will have access to the Plus-membership for the rest of your initial 12-month period.

You will gain access to the Plus-membership and all its functions right away. If you upgrade your membership in the middle of a monthly purchase period, any purchases made prior to the upgrade will be transferred to your new allowed number of purchases. For example, if you have purchased 3 of 5 products during a monthly purchase period, you will have purchased 3 of 25 products after the upgrade.

When you upgrade your membership, we will adjust your payment accordingly. If you have an annual payment plan, we will charge the additional cost for the upgrade at the time of the upgrade. If you have a monthly payment plan, we will charge the additional cost for the current month at the time of the upgrade. The additional cost for the first month will be calculated based on what day of the one-month period you upgraded your membership. For the following monthly payments, you will be charged with the cost for the Plus membership.

8. Term and termination

All membership plans run for 12 months from the day you sign up for your membership. When the 12-month period has ended, your membership will be automatically renewed if you have not notified us that you do not wish for your membership to be renewed. You may give us a notice of your wish not to renew your membership at any time during the 12-month period.

One (1) month prior to the end of the 12-month period you will receive a reminder from us with information about your options regarding the automatic renewal.

It is the membership plan which is active at the end of the 12-month period that will be automatically renewed. Therefore, if you have upgraded your membership, or if you wish to change your membership from Plus to Base, you will need to notify us to not renew your membership. Instead, you will have to sign up for a new membership. If you have any questions regarding renewals, please contact us at hello@singular-society.com

You have the option to terminate your membership within 30 days from the day that you signed up for membership on the condition that you have not made any purchases or that you return any purchased products.

9. Right of withdrawal exchanges and other rights

Withdrawal

We offer our members the option to withdraw the purchase of the Service by submitting or sending notice thereof to Singular within 30 days from the date you signed up for the Service. Please not that you must return any purchased products in order to exercise your right to withdrawal.

Your purchase of the Service does not grant you the right of withdrawal in accordance with Swedish Consumer Law. This is because the Service will immediately be fulfilled when you are given access to purchasing products in accordance with your membership plan. The possibility to withdraw from the purchase of the Service within 30 days from the date you signed up for the Service is a courtesy from Singular to our Members.

Regarding the return of any purchased products in order to exercise your right to withdraw the purchase of the Service, please see more information in our Terms and Conditions [LINK].

The notice may be sent in different ways. You can send us an e-mail or use the standard form that can be found at Konsumentverket’s Website [LINK ]. Please send the notification to our address at Kungsgatan 55, 111 22 Stockholm or e-mail it to hello@singular-society.com.

Please note that you do not need to use the special forms but may send us a letter or an e-mail to the above-referenced mailing and e-mail addresses including information that you will withdraw your subscription of the Service. If you send us an e-mail we will send you a confirmation upon receiving your notice. Please always refer to the e-mail address used for your account in your communication with us. You may wish to keep a copy of your cancellation notification for your own records.

Refund relating to the right of withdrawal

If you choose to withdraw your purchase of the Service in accordance with the terms set forth in this section 9, Singular will issue a refund of the amount paid to Singular and cancel future payments for your membership. Singular will also issue a refund of any purchased products. Please note you will have to pay for returning any purchased products and that Singular is not responsible for reimbursing you the cost for return shipping of any purchased products.

Singular will pay the refund within 14 days of the date on which we have received your notice of withdrawal, granted that we have received any purchased products, or evidence that you have sent the purchased products to us. The refund is made using the same payment method you used at the purchase if you do not explicitly accept another method. You will never be charged extra if another payment method is used. 

Exchanges

You can upgrade your membership at any time during your subscription of the Service. However, you are not able to downgrade your membership during the 12-month period.

10. Refusal, suspension or termination of membership

We may, at our own discretion, immediately restrict, suspend or terminate your membership and access to the Service if we consider you in breach of these Membership Terms, any other rules for the Service or applicable law. Singular preserves its right to review your member account in case of suspicion of abuse of the Service.

We reserve the right to refuse membership at our own discretion, for example due to your previous breaches of Membership Terms.

11. Provisions severability

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead, the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

12. Governing law

These Terms and Conditions are governed by the laws of Sweden. Except where prohibited and without limitation to any statutory rights for consumers, all disputes pertaining to these Terms and Conditions will be exclusively referred to the district court of Stockholm, as the court of first instance.

TERMS AND CONDITIONS

1. General

The following terms and conditions (“Terms and Conditions”) are valid between you and Singular AB (Reg. No. 559226-1647) (“Singular”, “us”, “we”) and apply to all use of and orders placed on Singular’s website www.singular-society.com (“Website”).

By using the Website and/or placing an order on the Website you confirm that you have read the Terms and Conditions and that you accept to be bound by them. Before you accept the Terms and Conditions you shall also read and understand our Privacy Policy [LINK].

Orders may only be placed by individuals that are 20 years or older. Please note that we presently only deliver our products within the EU.

Singular reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Please note that the Terms and Conditions valid for your order is always the Terms and Conditions that you have read and accepted before you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference. 

Please note that Singular does not guarantee that all products presented on the Website are in stock or are available for purchase. Singular preserves its right to stop selling a product. 

The language of the Terms and Conditions is English. 

2. Placing an order

Please make sure that you read and understand the Terms and Conditions before you place an order.

Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you place your order. 

If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

3. Order confirmation 

After submitting your order, Singular will send you an automatic order confirmation via e-mail to confirm that we have received your order and that we will start to control the availability of the order. Please note that the order confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order. For more information, please see section

4. Acceptance and shipping confirmation

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose to not accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. The shipping confirmation is our acceptance of your order.

Please note that Singular does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. 

If we already have received payment for the order we will refund the amount to you should we for any reason not accept your order. 

5. Colors

Singular’s goal is to describe the products at the Website as correctly as possible. However, please note that due to the color settings of your device, the colors of the products shown in the pictures on the Website can differ somewhat from their actual colors. Singular cannot be held responsible for any such discrepancy. 

6. Prices

The prices and delivery costs shown on the Website include VAT.

The prices and delivery costs shown on the Website may vary from time to time and Singular is not bound by the price until Singular has accepted the order by sending the shipping confirmation to you. The prices may also vary between the physical store and the Website. 

If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. Singular always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will repay the amount to you. 

Please also note that Singular may cancel the order even if it has been accepted by Singular under the condition that you realized or should have realized that the price information was incorrect. 

Please note that the delivery costs are not included in the prices for the goods. The delivery costs are shown in connection with the shipping methods at the checkout stage, and below in Section 8. 

7. Payments

We use Shopify’s payment services. For more information, please see Shopify’s Payment Terms [LINK]. 

We accept the following payment methods: 

When you pay with a credit card the purchase amount is reserved prior to Singular’s acceptance of the order. The purchase amount is debited once Singular has accepted your order by sending you the shipping confirmation.  

Please note that we are unable to cancel an order once the order has been sent to our warehouse. If you wish to cancel an order we kindly ask you to return the order in accordance with Section 9.

We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order. 

Please note that if you choose to pay by American Express, iDEAL, Bancontact, invoice (Klarna Pay Later) or installments (Klarna Pay Later or Klarna Slice It) additional fees may be applicable. 

8. Delivery

Shipping methods

We ship within the EU from our warehouse in Stockholm, Sweden. We offer different shipping methods to meet your needs. Please see all shipping alternatives, estimated delivery time and costs below.

Your order will be shipped within an estimated time of 10 hours from the time you receive your shipping confirmation on business days (not including public holidays).

Destination: Sweden

DHL Service Point, cost SEK 75 (7,5 €), delivery time 1-3 business days.

Budbee Home Delivery*, cost SEK 75 (7,5 €), delivery time 1-3 business days.

Airmee Express**, cost SEK 125 (12,5 €), delivery time 3 hours.

Pick up: If you are in Stockholm, you may choose to collect your order at our store at Gamla Brogatan 28, 111 20 Stockholm, Sweden. Pick-up at our store is free of charge. Find our opening hours here [LINK].

*Budbee offers home delivery between 5 PM and 10 PM or to a preferred delivery box in Sweden where you can collect the parcel with a code that is sent to you. Budbee may be used in the following cities: Stockholm, Göteborg, Malmö, Lund, Helsingborg, Linköping, Örebro, Uppsala, Västerås, Norrköping, Jönköping, Södertälje, Eskilstuna, Borås and Trelleborg.

**Airmee Express is a local home delivery service, delivering within 3 hours within the greater Stockholm area.

Destination: Europe

UPS Standard, cost SEK 75 (7,5 €), delivery time 2-5 business days.

UPS Express, cost SEK 220 (22 €), delivery time 1-3 business days.

Budbee Home Delivery*, cost SEK 125 (12,5 €), delivery time 1-3 business days.

*Budbee offers home delivery between 5 PM to 10 PM or to a preferred delivery box where you can collect the parcel with a code that is sent to you in Finland, Denmark, and the Netherlands. Budbee may be used in the following cities:

Finland: Helsingfors, Vantaa, Åbo, Tammerfors, Uleåborg and Espoo

Denmark: Copenhagen

Netherlands: All cities

 

Please note that we are unable to change the delivery address once the order is placed, that we cannot cancel an order once it has been sent to our warehouse, and that delivery to rural addresses may result in longer delivery times. 

The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If Singular fails to deliver within 30 days, you may have the right to cancel the purchase.  

Extended delivery time

Please note that some products are offered on a pre-sale basis. These products may have an extended delivery time. These products must be delivered from our suppliers, resulting in an extended delivery time. If an extended delivery time is applicable for a product, this will be clearly stated for the respective product and at checkout. 

9. Right of withdrawal, returns and other rights

Withdrawal

You are entitled to withdraw your purchase or exchange your product by submitting or sending notice thereof to Singular within 14 days of the date on which you have received the product. The notice may be sent in different ways. Preferably, you can use our return form provided together with the delivery. You can also use the standard form that can be found at Konsumentverket’s Website [LINK]. You may wish to keep a copy of your cancellation notification for your own records.

Singular will pay the refund within 14 days of the date on which we have received your notice of withdrawal, under the condition that Singular has received the product/s from you or if Singular has obtained proof that the products have been sent back to Singular. The refund is made using the same payment method you used at the purchase if you do not explicitly accept another method. You will never be charged extra if another payment method is used. 

Please note that Singular only issues a full refund if the product/s are in the same conditions as at the time of delivery. If the products’ value has diminished due to your handling of the products to a greater extent than is necessary in order to ascertain its characteristics or function, you have an obligation to reimburse us. Thus, Singular then has the right to withhold such amount of the refund. 

Please note that if you have chosen a delivery method other than Singular’s standard shipping service we will only refund the shipping costs with an amount equal to our standard shipping service. 

To avoid a deduction, please make sure all products are in the exact same condition as you when received them, with tag and seal still attached. All shoes must be tried on a carpeted surface until you have decided to keep them. Shoes must be returned in their undamaged original shoe box which is considered to be a part of the product.

Exchanges

Purchased products are exchangeable into a different size and color in accordance with the terms set forth in this section 9. All exchanges are based on stock availability.

If you wish to exchange a product for a new product and/or size you may simply withdraw your previous purchase and place a new order with your preferred payment method. The new order is paid for separately and will be handled as a new order. 

Shipping costs for returning the products

Please note that you must pay the shipping cost for returning the products in accordance with your right of withdrawal and exchange and Singular has no obligation to pay such costs.

Exceptions / non-returnable items 
Certain types of items cannot be returned, such as hygiene products, food and beverage and underwear. Please get in touch with us if you have questions or concerns about your specific item at hello@singular-society.com. 

Returning the products

Upon your withdrawal or exchange of your purchase, please return the product/s as soon as reasonably practicable and no later than 14 days after sending your notice.

We prefer that products are returned through Singular’s return service to ensure they are protected and insured during transit. However, you may return the products by any secure transport.

10. Defective products 

If you receive defective products, please notify us immediately. According to the Consumer Act (1990: 932) you are entitled to complain about defective products within three years. However, you must always notify Singular within a reasonable time after you have detected that the products are defective. If Singular considers the products to be defective, Singular will, depending on your preference, replace the defective products or make a full refund including shipping costs. In both cases you have to return the defective products. Please see more information about your legal consumer rights in the Consumer Act (1990: 932) or by visiting www.hallåkonsument.se.

11. Singular’s quality guarantee

Singular acts in accordance with applicable consumer regulations. Please notify us as soon as possible after receiving defective products.

You may purchase products on the Website for personal use only and not for commercial use. By placing an order on the Website, you certify that you are purchasing products for your own personal use and not for resale and that you accept the Terms and Conditions.

Singular cannot promise that the content of the Website is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. Singular may, at any time, amend the content of the Website. Although Singular strives to display the correct texts, images and pricing on the Website and online shop, errors may occur.

Part of the services provided through the Website are provided by third party operators, such as certain payment service providers. In situations where Singular acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. Singular cannot be held responsible for any damage caused from using the Website or, for that matter, not being able to use the Website. 18. Violation of rules

Singular reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the Website.

Individuals violating the restriction of password-protected areas of the Website may be subject to prosecution.

19. Singular’s responsibility

Singular’s liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law. In no case whatsoever will Singular assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events.

Singular’s liabilities to you will never exceed your total purchase amount for each order, unless otherwise is stipulated by law. 

In case of force majeure, Singular’s obligations will be suspended. The contract between you and Singular can, in such cases, be partially or fully terminated by yourself or by Singular.

20. Provisions severability

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead, the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

21. Governing Law 

These Terms and Conditions are governed by the laws of Sweden. Except where prohibited and without limitation to any statutory rights for consumers, all disputes pertaining to these Terms and Conditions will be exclusively referred to the district court of Stockholm, as the court of first instance.

Privacy policy

1. Introduction

Singular recognizes the importance of protecting the privacy of your personal data. We have instituted strict policies and security measures to protect the information you provide us. 

The purpose of this privacy policy is for you, as a member to learn how Singular handles your personal data and for you to be able to feel secure that the processing is being carried out in accordance with the General Data Protection Regulation and other applicable data protection law. The privacy policy also describes your rights vis-à-vis us and how you can enforce those rights. By subscribing to our membership services, you confirm that you have read and understood the content of this privacy policy.

This privacy policy is aimed towards you as a member belonging to one or more of the following categories.

2. Who is responsible for the processing of your personal data?

The Swedish company Singular AB, reg. no. 559226-1647 (“Singular” "We" "Us"), is the controller of your personal data. Singular’s selected suppliers may process your personal data on Singular’s behalf and in accordance with Singular’s instructions as stated below and are thereby processors of your personal data.

3. Categories of data processed, purpose and legal basis for processing

Set out below is a summary of the categories of data that we process, the purposes of processing the data and on what legal basis we are processing your data. Our processing of your personal data partly depends on whether you have subscribed for membership with us or not. The processing of our members’ personal data is described in section 3.1 below. The processing of data in relation to persons that subscribe to our newsletter is described in section 3.2.

3.1               Members

When you sign up to become a Member, Singular collects your name and e-mail address to create and administer your account. Furthermore, your phone number and address (including street name, zip code, city and country) is collected and stored to make future purchases quicker and to provide you with relevant information regarding our products. Purchase history is stored to provide you with the possibility to review your purchases and returns and for us to send relevant information to you. Your IP address and purchase and web browsing behaviour is also collected and stored as well as what websites or search terms referred you to Singular’s website, and information about how you interact with the Site. This data is processed to be able to send you information and offers tailored to your interests. 

Your date of birth is collected so that Singular may verify that you are eligible for certain products offered to our Members.

The legal basis for the processing of your data as a Member is that it is necessary to fulfil a contractual obligation namely a service which includes (i) a subscription service that entitles you to receive all Singular’s product offers (ii) a smooth order placements process once you purchase a product online (iii) allowing you to access and review previous purchases and returns and (iv) access to relevant and personalized information regarding Singular’s products.

The legal basis for the processing of data regarding your date of birth is that it is necessary to fulfil Singular’s legal obligations relating to age restrictions for certain products.

When you purchase a product online your name, e-mail, phone number, shipping address and billing address (including street name, zip code, city and country) are used to process your order. The data is also processed so that Singular can process any returns, exchanges, and complaints as well as communicating with you regarding any questions or comments you may have regarding the product(s). The e-mail and phone number are collected so that we can send an e-mail and/or a text message to you when the product(s) have arrived at your pick-up place. The legal basis for the processing is that it is necessary in order for Singular to fulfil its contractual obligations to deliver purchased products to you.

You purchase history is also stored so that Singular can process any returns, exchanges, and complaints as well as communicating with you regarding any questions or comments you may have regarding the product(s). The legal basis for the processing is a balancing of interests where Singular’s legitimate interest is to facilitate the administration of returns, exchanges and complaints.

Information regarding returns are also stored for accounting purposes. This is based on Singular’s legal obligations.

If you choose to pay your subscription and/or product by credit card, you will provide your credit card information on our website to finalize your purchase. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the subscription and/or purchase agreement. We will retain your data for as long as necessary for this purpose.

3.2         Newsletter subscribers

If you have subscribed to our newsletters, we will use your name and e-mail to send out the newsletter. Your IP-address will also be collected in order to send marketing based on geographic location, such as country or city. The legal basis for this processing is that it is necessary to fulfil a contractual obligation, namely providing the newsletter. The newsletter will be sent to you until you unsubscribe to the service.

3.3         Anonymized data

It can be noted that we may also use anonymized data for statistical purposes.

4. Does Singular share your information with others?

Singular does not sell or rent our customers’ personal data to any other entity.

Singular may share your data with selected suppliers who perform functions on our behalf such as fulfilling and delivery of orders, processing payments, carrying out promotional services or data management, to maintain our website, to distribute e-mails, to send out our newsletter, to provide client communications and to manage our customer database. To the extent necessary, the personal data you provide to us may be processed by these third parties, solely on Singular’s behalf and in accordance with Singular’s instructions to the data processor. We do not authorize any of our suppliers to make any other use of your personal data.

If Singular is subject to an actual or potential merger or acquisition or similar transaction, we may share your data with potential and actual buyer(s) and their financial and legal advisers, subject to such third parties undertaking appropriate confidentiality.

Singular may also disclose your personal data to a public authority where Singular is obligated to do so by law. In the event that all or part of Singular’s operations are sold, Singular may transfer your personal data to a potential purchaser of the business.

5. Transfer outside of the EU/EES

We may share your data with our selected suppliers, who may process your data in countries both inside and outside of the EU/EES when performing functions on our behalf as set out in section 4 above.

Please note that countries outside of the EU/EEA may not provide an adequate level of protection for your personal data. Singular has however taken appropriate safeguards to ensure that the receiving parties of your data in countries outside of the EU/EEA shall provide an adequate protection of your data. Such safeguards may be that the receiving party has signed so called standard data protection clauses adopted by the EU Commission. 6. How long do we keep your data?

6.1               General

Singular reserves the right to keep and process personal data for as long as necessary in relation to the purposes for which the data was collected as set out in this policy.

6.2               Members

The personal data collected and processed for Members as set out in section 3.1 will be saved and processed for as long as you are a member. After termination of the membership the data will be deleted within [3 months]. However, your e-mail will be saved for up to 12 months from termination of the membership for direct marketing purposes, subject to your ongoing right to opt-out. Thereafter it shall be deleted.

If you make a complaint Singular may save your data, also after termination of the membership, to the extent necessary to handle the complaint. Singular may also save the complaint information as such for the remaining period under which the customer is entitled to make a complaint in order to prevent a customer from filing two complaints and being compensated twice for the same defect.

The information regarding return for accounting purposes shall be stored as long as legally required by applicable law.

6.3               Newsletter subscribers

The personal data collected and processed for persons subscribing to the newsletter, as set out in section 3.2 will be saved and processed for as long as you are subscribing to the newsletter. The information can be saved as long as you do not unsubscribe from the newsletter but no longer than three (3) years from the subscription date, unless you confirm that you want to keep receiving the newsletter.

7. Your data subject rights

In this section 7, we have summarized your data subject rights to request access, portability, rectification, erasure of your personal data, to restrict the processing of your personal data, to object to processing, and your right to lodge a complaint with the supervisory authority.

Right of access

You have the right to obtain confirmation of whether personal data concerning yourself is being processed and, where that is the case, access to the personal data and information regarding, inter alia, the purpose of processing, the categories of personal data concerned, the categories of recipients to whom your data have been or will be disclosed, and the envisaged period of time for which personal data will be stored (or the criteria for determining this).

Right of rectification

You have the right to request rectification of inaccurate personal data concerning yourself, and to complete incomplete data.

Right of erasure

Under certain circumstances you are entitled to request that we erase your personal data or restrict our processing of your data, namely in the following events.

Right to objection - direct marketing

You have the right to object at any time to our processing of your personal data for direct marketing purposes. If you object to our processing of your personal data for direct marketing purposes, we will cease such processing of your data.

Data portability

If our processing is based on your consent or if the processing is necessary for our performance of a contract with you, you have the right to request that the data which you have provided to us shall be provided to you in a structured, commonly used and machine-readable format and you also have the right to transmit such data to another controller.

Right to lodge a complaint with supervisory authority

Please note that if you consider the processing of your data to be in violation of applicable data protection laws, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence or the place of the alleged infringement.

8. How do I unsubscribe from Singular’s newsletters and e-mails?

If you no longer wish to receive our newsletters or other e-mails, you can unsubscribe as indicated in the particular communication, i.e. by using the unsubscribe link which is included on all newsletters and other e-mails. You may also contact us at privacy@singular-society.com.

9. Is it mandatory to provide personal data?

Certain personal data is required to provide in order for you to access certain services. For example, to enter a subscription with Singular. The provision of mandatory data is necessary for Singular to be able to fulfil our contractual obligation to you, for example processing your order, to fulfil our legal obligations or fulfilling the account services.

10. Children's privacy and legal purchase age

Singular does not wish to collect personal information from anyone under the age of twenty (20).
